Thanks to an injunction granted Judge Kenneth Bell, 23XI and Front Row Motorsports will be able to continue with business as usual next season.
For the past few weeks, things had been looking pretty grim for 23XI Racing and Front Row Motorsports. Thanks to a Christmas miracle – and a preliminary injunction – things are looking up for the embattled teams heading into the 2025 racing season. According to our friends over at Jayski’s Silly Season Site, a judge issued a preliminary injunction Wednesday morning that will allow both teams to compete as chartered teams in 2025. This injunction will also allow for the transfer of the charters both teams purchased from Stewart-Haas Racing earlier this year.
Naturally, NASCAR plans on appealing the ruling. However, this early victory is important to the future of the lawsuit. Apparently, U.S. District Court Judge Kenneth Bell made the ruling based partially on information that driver Bubba Wallace was looking to explore his options with other teams, and that sponsors were looking to leave 23XI and FRM if they weren’t able to run as chartered teams. This injunction more or less clears a major hurdle in the case against NASCAR.
By granting the injunction, there is an acknowledgement by the court that NASCAR operates as a monopoly to some degree. Bell stated that “The Court finds that NASCAR possesses monopoly/monopsony power in the relevant market,” explaining that IndyCar and Formula 1 are not comparable in this situation, as NASCAR maintains a monopoly on which teams can compete at the highest level of stock car racing in the United States. However, it is up to the 23XI and FRM legal team to prove that that monopoly is anti-competitive, which is to say, that other stock car racing series cannot succeed without NASCAR.
While the appeal from NASCAR is imminent, this ruling represents a massive step forward, and will allow both teams to focus on the upcoming season instead of wondering if they will be able to compete at all. In a statement, Jeffrey Kessler, lawyer for both teams stated that “We are confident in the strength of our case and will continue to fight so that racing can thrive and become a more competitive and fair sport in ways that benefit teams, drivers, sponsors and, most importantly, our fans.” Here’s hoping for the best. While 23XI and FRM clearly have a bone to pick with NASCAR, it’s clear that they care a lot about the health and future of the sport and are trying to do what they believe is right for everyone from the competitors to the fans at home.
