The first time I did send him the parts (for the exact same order placed the 2nd time) and he still disputed it with his cc company. He tried to do it the second time as well, we just didn't go through the whole process. He filed the dispute with PP and they refunded him him money. I in turn have to pay PP back because they refunded him. He didn't get any parts, he was refunded his entire payment.

Fogger filed a dispute with PayPal and I guess they told him that we had a negetive balance and the funds weren't available. This did not stop him from filing a dispute with his cc company. They went to bat for him against PayPal, which is who he originally paid, and was awarded the money back from PayPal. He got his money back, just not directly from me.

See, that is the funny part. I have my doubts as to whether paypal paid him or not. They did't pay me shiit and told me they paid me. They paid me and took it back another way. He maintains that he was NEVER paid on this from paypal or anyone else. You can't seem to post up any proof otherwise either??? If your paypal rep told you he was paid, have them fax it on over to you. If they did pay him, the have the transaction documented as to how much and what account it was paid to. That should not be so hard to verify, ESPECIALLY IF YOU ARE MAKING PAYMENTS TO PAYPAL. Get paypal to fax you verification of the refund or get legal help to MAKE them give you documented proof. I would think by now you would want to prove your point. Hell, I would have wanted to 17 pages ago. Clear your name on YB and RJ.

I had another guy send me something that might help clear up how PayPal works. I will post his message and I will also call PayPal tomorrow and get something from them in writing.


6.Seller responsibilities for Non-Receipt of Goods reimbursement requests. If a buyer has purchased a Money Back Guarantee and submits a reimbursement request that indicates non-receipt of goods, and if the seller does not provide a tracking number or proof of refund to PayPal within 7 days after the buyer files a reimbursement request, PayPal may (1) refund the buyer out of the seller's account or (2) reimburse the buyer and then recover the funds from the seller. If the seller does not have sufficient funds in his or her PayPal balance in the currency of the original transaction, PayPal may limit the seller's access to his or her account until the seller authorises PayPal to use funds from their balance, bank account, and/or credit card to recoup the amount paid to the buyer. And yet another bit of information that was passed on to me from someone on YB that may be interesting to all of those that have been reading this thread...

Pretty sure your buddies name is Tony Thorne. He pulled the same BS with a guy on here over a Dart block, it was also listed on ebay. He used the same screename. Needless to say the block didn't exist, and the buyer had sent money via paypal and sent a Jeg's gift card too. The gift card was used as soon as it was recieved, and goods for a bbc were delivered to a vacant address in Dallas. The seller, who went by the name of James Jones (who the parts were sent to and signed for according to Jegs) claimed that the card had been used before he got it. Anyways, he used all the same lies that he is telling now, and tried to make the buyer (Pat) out to be the crook. Pat has spent 1,500 with our company and we didn't have any problems with him, so I know this guy is full of shit. This guy is telling the same lies as he told with Pat, and his story keeps changing. The same BS about paypal holding the money and seller taking it out of the paypal account. There was a huge thread on the deal, but it got deleted. I asked some racers in Dallas if this story sounded familar and they told me that it sounded like a guy named Tony Thorne. He's the reason Jegs and Summit won't ship COD to Dallas. He would give a vacant address and wait for UPS to show up and hand them a bad check with a false name. When TwinFoggerBBC first started posting, he had a picture of a purple camaro as his profile pic, I posted it on a Dallas racing site and several people told me it was Tony Thorne's car. The idiot even bragged about racing at Kenandale, where Tony run's all the time. I put his picture and put the name Tony Thorne on the thread that got deleted and he refused to acknowledge or deny the name. However I found where a Tony Thorne in Galveston, Tx was arrested for child molestation and brought that up on the thread. It was of course a different Tony Thorne, but he started defending himself, and got pissed that someone accused him of being a child molester, yet wouldn't admit to being Tony Thorne. Why would James Jones care if Tony Thorne was getting called a child molester? I hope this helps, I have another guy that got ripped off by him too that sent me a message on myspace. I hope this bastard gets caught. I think he had another screename of TwinPwrdBBC too. Pat is still a member, he's Canadian so really didn't want to pursue anything legally. Hard point is tying Tony Thorne to the scree name!

Hows that proof? I dont know if thats from Paypal or not, regardless it doesnt matter to me because I think Paypal is just as big a crook as Dwight of kyspeedparts. Their work speaks for itself too. Dwight, the complaints on your BBB profile...those guys tried scamming you too? I dont trust Paypal, they are crooks and it has been proven. People simply use them because theirs no other alternatives. I knew just how much of a crook they were when they let Dwight steal my money and even though they TOOK % of the money they still tells me THERE WAS NO MONEY recovered when at the least the money they took from the payment should of been recovered. The email from Paypal proves what I got back, and thats nothing because Dwight had already stolen the money and he admitted he put the money into his bank acct and closed it before Paypal could take it back. Fogger orders 4 items from KYSpeed. I believe Fogger's intent was to use the paypal chargeback scam; See this link:

Once he had received the merchandise, he would file a dispute with paypal and get his money back. He would win the dispute and have cash and items.

He would have the boxes and have paid nothing. A common scam and it would be up to KY Speed to pursue, and probably not worth it for $3,320.

However the scammer got "scammed" by KySpeed. Why? Because KYSpeed didnt ship the items. lol

So Fogger sent the cash, KYSpeed didnt send the items. KYSpeed pulled the money out of the account, and then Paypal upheld the dispute and sent Fogger his cash back. Thats why KYSpeed is on a payment plan- he is simply giving them back what he already removed.

So effectively everyone is where they started lol. And thats why they both have letters- You see these are auto-generated letters that are based on keywords in the email lol.

Fogger has his $3320 but not the boxes he intended to misappropriate from KYSpeed.

KYSpeed has his $3320 worth of boxes which as Tod74 alluded in another thread he SHOULD have shipped when they were ordered. He held the boxes and had the cash. Is that a scam? remember he already posted that he was doing a daily sweep from his Paypal account- he should have sent those boxes immediately. He waited and while he waited, Fogger implemented his chargeback scheme. lol.

It was only by not shipping timely and holding the merchandise that was paid for that he disrupted the scammer.This is hilarious.

It's easy for you to set there and say that both myself and twinfogger are both dishonest, but that fact of the matter is, I did my part in supplying everyone that has been involved in this thread proof that he was going to scam me. I'm not going to make excuses for what happened, but I personally had a very rough time last year. It all started right about the time this crap happened. Whether it was myself or someone else that withdrew the money from paypal, is irrelevent. It was common practice. This whole transaction was done just prior to a weekend. I decided not to ship the boxes and that's all. If I had shipped the boxes, I would have been out the parts and the money for the parts. I am always open to suggestions and am willing to listen to about anything. I am listening to what you are saying and will take it in stride. As far as the discounts to YB, I did that because someone had mentioned it in the thread, not to try and please someone else. I will take the criticism as constructive criticism and try and build on it. Thank you for you honesty.

However, the difference is you did recieve your parts, all be it a little later than you would have liked. I made it right with you.
