No lively, in court he may not lose, (he would lose), the buyer bought the motor based on what it was advertised as having in it. Hearing it run would not evaluate what's inside the motor. Bottom line the seller would lose for misreprensation of the motor and shame on him for advertising what he did or didn't know he had. Too many people today are selling parts/motors that have no clue about what's in them and we see it every week here on RJ.
