Anyone done business with this guy? Kevin Shull Ad #1218607
I contacted him thru RJ and he gave me a price for shipping and said "Usually ships within 10 days". I asked for some kind of order blank or invoice and he sent me this link:

The address on the order blank, from what I can determine is a residential address. The phone number on the RJ ad and the order blank is registered to another person, but says ksracecars on the voicemail.
I sent him $1,065 paid with a cashiers check from my bank. On August 15th he sent a message stating that he received the check and "would get things going." Before the 10 days were up (Aug 28) I sent a message asking for an approximate finish date. No response. On Sept. 3rd I called both numbers on the order blank, got voice mail both times. On Sept 3rd he sent this message, 2 minutes after I tried calling him: "Hey there, I'm running a little behind, sorry. I hope to finish up the jacks this week. I pulled the ad due to overwhelming response". The fact is, the ad expired. I haven't heard from him since Sept 3rd. It seems logical to me that if he had an "overwhelming response" he wouldn't have told me "Usually ships within 10 days". unless the "overwhelming response" was after I placed my order, which would place me at or near the top of the list. When trying to access the order blank I mistakenly entered the URL and found this website: http://www.geocities.com/ksracecars I clicked on the link for the jacks (products) and there is an email address. When trying to contact him on Sept. 3, I tried sending a message directly using that email address and got the {delivery failure notice} both times. There is another phone number on the website that is no longer in service. The website looked legitimate to me, albeit the URL seems a little strange for a business. All contact was thru RJ, even though I provided 4 alternate methods to contact me.
Sorry this post is so long but I edited it down as best I could but wanted to get as many facts on here as I could. Any comments, suggestions?

Ok, I haven't heard from this guy since Sept 3rd. This morning Sept. 29th I filed a report with IC3 (Internet Crime Complaint Center) Probably won't do anything to get my money back but at least it will be on file. I'm going to just pay the money and go thru a reputable business like Jerry Bickel or Pro Jack and buy a set of jacks.
Lesson learned.

Dont let this drop; if you sent hard earned cash and this guy didnt complete his end of the deal-you have recourse.
You have a home address for him-file a claim with the attorney general in his state. You sent payment out of state-notify the local authorities in his state. File a police report.
He has $1100 of yours. Chase this guy. If he is going to keep it then impart some misery on him and let him earn it.
Also, if you pm me seprately I can tell you how to do a look-up on his phone numbers so that you can verify addresses.
Also-you might want to pm VinceF through this board-he is on top of how to pursue a situation like this.
Dont drop this-you owe it to yourself and others who might go through this guy.
If you have this guys profile on RJ message him and let him know the deal made it to a public forum.

Thanks for the info Scorp. I have his home address and his wife's name and his cell phone number. I also have the name (and wife's name) and home address and home phone number of the person who's the registered owner of the phone number he uses. I found 3 different business addresses for him, from 3 different locations, but not sure which or if any are legitimate or current.
It's my understanding that IC3 files the necessary reports with the proper agencies. Maybe I misunderstood that part tho.

If hes a VW guy they know him on the SAMBA-Its big. Last thing he'd want is to be "outed" there. I'd post on their user feedback board.

I got a message from Mr. Shull this morning, apologizing for the delay. He states that the cylinders he uses have been on back-order for weeks, and that they should be arriving early next week. He stated that I should have contacted HIM before I "slammed" him on the net. He also stated he would contact me on Monday to let me know "where we are". :roll:
:!: I sent a reply reminding him that I provided him 4 alternate ways to contact me, besides thru RJ, and that I thought that it would be prudent of him to let ME know if there was a problem, even if (or especially if) it's beyond his control, (back-ordered) especially since it's been over a month since I heard anything from him.
:arrow: I told him that I would add a post here saying that he made things right, when and if he does.

I would just ask for my money back and not take this any further. If he hasn't provided you any parts yet, and he has "overwhelming response", then he should not have a problem giving you a refund.
If he refuses a refund.....that tells me that he doesn't plan on doing the right thing anyway. Just my $.02 worth.

Well, I guess it should be no surprise that here it is Friday and I didn't hear from Mr Shull on Monday like he said. He also told me the jacks would be ready to ship by the end of the week (this week), but I guess that ain't gonna happen either. Imagine that! So here we are 2 months into this, what I was told "usually ships within 10 days", and still nothing but apologies.

I sent a message to Mr. Shull since I haven't heard from him inquiring about the jacks and advising him that my complaint with IC3 is still active (but can be amended or canceled) and that my next step would be to post my experience on the Samba website. Evidently he wasn't worried about it because he never replied.
I joined the Samba website today and did a search on the forums there and it seems Mr. Shull was given $2500. from some guy in the Netherlands to rebuild a VW gearbox or some kind of gearbox anyway. The original posting was dated back sometime in July 2008. Not surprisingly, the man cannot get into contact with Mr. Shull. I added a reply to his posting telling of my experience with him. I also pm'd this guy and urged him to file a complaint with IC3 as well.

He is a business. Do a web search on attorney general his state-Get the address and file a complaint AND suggest that the other guy from the Samba do the same. Two complaints to the Attorney General with support should get them rattling his cage a bit.
Also-Just my opinion, but I would head to the courthouse in my state and file a lawsuit against this guy in small claims - You have his address.
Nitro-This guy doesnt fear you yet- make him. And you have to do it withhout threats-That wont budge him but a steady attack using all legal means will make him have to play and thats what he is not going to want to do.

Thanks to Racefab for the offer and to Scorp for the advice. I have the link to the South Carolina Attorney General website in my bookmarks, and have had it since this all started. I looked for his name on the "watch" list, but he's not on it yet. I'll see if I can change that! I have to inquire if, since I filed a complaint with IC3, if I should file a complaint with the Atty Gen office too. I like doing things slow and methodical to give him every opportunity to make things right. I'm not even sure if he saw the message I sent him thru here, all contact is being done thru RJ. I need to go see my attorney on a different matter soon, so I'll inquire about this before I take any legal steps, but that's probably gonna be my next move, after the Atty Gen.

Since I haven't heard from Mr. Shull since Oct 9, I decided it was time to take the next step. I filed a complaint with the South Carolina Department of Consumer Affairs. I sent a message to the guy from the Samba website to do the same, but haven't heard from him either.

:arrow: Firstly, I heard back from the guy from the Netherlands. He wanted to wait a couple more weeks in hope that Mr. Shull will contact him before taking any action. :roll: I urged him to file complaints with IC3 and the South Carolina Department of Consumer Affairs, and sent him links to do so.
:arrow: Secondly, I was contacted by another guy in a similar situation with Mr. Shull, but he didn't want me to mention it in the forums just yet, so out of respect I won't identify him, or give any more details.
:arrow: Thirdly, I filed a complaint with the Better Business Bureau in Columbia, SC. :wink:

BTW- recently was victim of an attempted Scam. A magazine that I used to subscribe to, started up my subscription automatically and sent me a junk mail letter saying if I didnt want this I had to actively tell them no-else they would restart and bill me.
I shred all junk mail unopened and didnt catch this. Got a magazine which I couldnt figure out and then a few weeks later an invoice. When I called to complain they played way dumb until I told them I knew they were passively subscribing me and it while not a guaranteed law violation was certainly unethical and since they probably did it to a large group that the Florida Attorney General will care. They begged me not to file a complaint.
I am working on the complaint doc as we speak-if only to help those others who did not catch it.
I posted this for two reasons:
1) Readers watch out for this scam and if you want to know the magazine and publisher, pm me,
2) the mention of the AG scared the death out of these people- Knowing the name and office info told them that a complaint was forthcoming and told me that AG's are investigating because of all the internet scams.
Nitro- do a google search on the AG for his state. Get the info. Email Shull. Get these other guys to file that claim as well. Three complaints will get the attention of the AG and should squeeze Shull a bit.
Its work and a pain but you are staying on this and you will recover I feel.
You are also helping other guys and should be proud of that.

If memory serves me right, when I was searching for the AG for South Carolina, I found the SC Department of Consumer Affairs. If I'm not mistaken, they are a branch of the AG and they are the ones that handle this sort of thing. The only "internet crimes" I could find on the AG website is crimes against children. But I'll have another look around and see what I can dig up.
The other guy that contacted me, wanted to know about how I went about filing a report with IC3 and SCDCA. I gave him the links I used. I urged both other guys to file reports themselves, and I mentioned to the BBB in an addendum to my complaint, that I had found 2 other persons who have had similar dealings with Mr. Shull. That's about all I can do, is urge them to file, it's up to them to actually do it.

The South Carolina Department of Consumer Affairs has assigned a complaint analyst to my complaint, and it was given complaint number 08-05433A3. They are awaiting a response, and will contact me again once it has been received. :)
The Better Business Bureau has assigned it case number 34017171. He has until November 25, 2008 to respond. :lol:
I'm not sure what happens f he doesn't respond, tho :?

Got a message from the guy from the Netherlands. He said he filed a complaint with the BBB and Mr. Shull has until Dec. 6 to respond to the complaint. I think they may have combined our 2 complaints, because Mr. Shull originally had until Nov. 25 to respond to MY complaint, but I just checked, and now he has until Dec. 6 to respond to my complaint also, unless this is his second notification of the complaint. Haven't heard anything of the other 2 complaints I filed with the other 2 agencies, but they're run by the government, so......go figure! :roll:
:arrow: Haven't heard back from the other guy that claimed to be a former friend of Mr. Shull, so I don't know if he was just doing a little investigating to see if I really was doing what I said I was, or not. Seemed a little suspicious that he just joined the day he sent me a message here, but he's been a member of the Samba site for quite a while. His last name starts with the same letter as Mr. Shull's also......coincidence? I dunno!

Well.....according to the complaint that I filed with the BBB, as of Dec 8, the case has been closed from a lack of response from Mr. Shull. Haven't heard anything from IC3 or the SCDCA (South Carolina Department of Consumer Affairs). Soooo....I guess that means we are going to small claims court!

Well...it seems Mr. Shull has found it somewhere inside himself to return my money. :o I received an express mail envelope today, with a cashiers check inside for the entire amount that I originally sent to him back in Aug. 2008. It even cost him $17.50 to send it :!: On the paperwork accompanying the check was a half-hearted apology, written by hand saying "sorry for your troubles" :roll:
