RACINGJUNK.COM 2009 IMIS BOX GIVEAWAY SWEEPSTAKES

1.       NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.

2.       VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

To be eligible for a chance to win the product prize (i) mail the fully and accurately completed entry form to: 2009 IMIS Box Giveaway Sweepstakes, Raceway Media LLC, 106 Main Street, North Adams, MA 01247 (the "Company Address"); or (ii) submit a fully completed entry form available online at http://www.racingjunk.com/2009giveaway (the "Site") between November 1, 2009 and November 30, 2009; or (iii) download/print the available online entry and mail the fully and accurately completed entry form to the Company Address; or (iv) send a four (4) inch by six (6) inch post card with first and last name, address, email, telephone, the prize for which you are entering,  and confirmation of age (18 or older) to the Company Address, to the attention of: 2009 IMIS Box Giveaway. Entry forms for the IMIS branded box must be submitted between November 1, 2009 and November 30, 2009 11:59 p.m. EST (the "Sweepstakes Period") for Online Entries. Mail in entries must be received by November 20, 2009 in order to be considered an eligible entry. Entries may also be submitted in person at the International Motorsports Industry Show, December 2-3, 2009 at the Indiana Convention Center. Entries submitted at the International Motorsports Industry Show must be submitted by 3 p.m. EST on December 3, 2009 in order to be considered an eligible entry. See PRIZE DETAILS below for further information regarding procedures for sending in eligible entries. No mechanically reproduced or photocopied entries will be accepted and entries generated by script, macro, bot, or other automated means will be disqualified. Neither Raceway Media, LLC ("RWM"), nor any of its affiliated companies, such as RacingJunk.com, or any of their employees, representatives or agencies is responsible for lost, late, misdirected, damaged, illegible, incomplete, incorrect or postage due/entries/mail, whether caused by participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical, human, or other error that may occur in the processing of entries. Entries become the property of RWM and will not be returned. For a copy of the Official Rules, send a self-addressed and stamped envelope to the Company Address, attention: Official Rules.

One (1) prize, a custom wrapped IMIS-branded Snap-on Classic 78 roll cab, will be awarded during the Sweepstakes period.  The specific duration during which entrants may enter this Sweepstakes, the “run time,” is The Sweepstakes will have a specific duration when entrants may enter is noted above under HOW TO ENTER and is also noted at http://www.racingjunk.com/2009giveaway.  Prize winners must satisfactorily follow the entrance procedures identified in HOW TO ENTER above and submit the online entry form by 11:59 p.m. EST on November 30, 2009.  Mail-in entry forms must be received by November 20, 2009. Entries submitted in person at the International Motorsports Industry Show must be submitted by 3 p.m. EST on December 3, 2009.  Only one entry per prize, per person permitted.  Any entries submitted beyond the limits specified herein, whether via entry form, mail-in or online methods are void, in RWM's sole discretion.  No prize substitutions allowed by winner.  Prize is not transferable.  All federal, state or other tax liabilities (including any resulting personal income tax) arising from this Sweepstakes will be the sole responsibility of each winner. Winner will be required to complete and return an IRS W-9 form to RWM.  RWM, in its sole discretion, reserves the right to substitute a prize of equal value if Prize becomes unavailable.

The Sweepstakes is open to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are 18 years of age or older at time of entry. Employees of RWM and its respective parent companies, subsidiaries, divisions, affiliated companies, advertising and promotion agencies, and their immediate families (defined as spouse, parents, siblings, and children), and those with whom such persons reside, are not eligible to enter or win. All Prize winners from any previous RacingJunk.com sponsorship contest are not eligible to enter or win. There can only be one Prize winner per household.  RWM, in its sole discretion, reserves the right to investigate any entries that appear to have been fraudulently or improperly made, including, but not limited to, any entries created by computer programs or by any non-members. All federal, state and local laws apply. Void where prohibited. RWM and its affiliated and parent company, advertising and promotion agencies, are not responsible for printing, distribution or production errors and may rescind, cancel or revoke the Sweepstakes or the drawings based upon any such error without liability and at its sole discretion.

6.       DRAWING, PRIZE ODDS & AWARDING OF PRIZES

One prize will be awarded with a value of $4795. The Prize winner must have fully complied with the entry requirements found in Section 4- PRIZE DETAILS.  Odds of winning prizes depend on the number of Eligible Entries received. The winner will be selected in a random drawing on December 3, 2009 from among all Eligible Entries received. The drawing and the awarding of the Prize will be conducted by RWM, or one of RWM's designees, whose decisions on all matters relating to this Sweepstakes are final. Potential Prize winners will be notified by phone and email on or about December 7, 2009 based upon information provided in the entry form. RWM, or its designee, will make up to three (3) separate attempts over a three (3) business day period to contact the potential winner by telephone and email. If RWM, or its designee, is unable to successfully contact a potential winner by phone and/or if potential winner fails to respond to the email notification within three (3) business days of such contact, such potential winner will be disqualified and forfeit his or her right to a Prize, and alternate potential winner will be selected from the remaining Eligible Entries. If a potential winner is unable to furnish verifiable and valid proof of age within three (3) business days after being notified of winning, an alternate potential winner may be chosen from among all remaining Eligible Entries received at RWM's sole discretion. Unclaimed Prizes may not be awarded. Winners agree that RWM may use their names or likeness for advertising and publicity purposes without any additional compensation (except where prohibited). All winners will be required to execute and return an Affidavit of Eligibility, Liability Release and (where permitted by law) Publicity Release within five (5) business days of successful notification, and entry into this Sweepstakes constitutes the winners' agreement to sign such releases. Non-compliance with any of the foregoing may result in disqualification and an alternate winner may be selected from among all remaining Eligible Entries, in RWM's sole discretion.

7.       GENERAL RULES OF PARTICIPATION

The receipt by winner of any prize is conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER (AT RWM'S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS A WINNER OF THIS SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of RWM, which are final in all matters relating to this Sweepstakes, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules.

RWM and its respective parent companies, subsidiaries, divisions, affiliated companies, advertising and promotion agencies, and the officers, directors, shareholders, employees, and agents of each (collectively "Released Parties") disclaim any responsibility for mechanical, technical, electronic, communications, telephone, computer, hardware or software malfunctions or failures of any kind, including, but not limited to: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or any web site or lost or unavailable network connections which may limit an online entrant's ability to participate in the Sweepstakes, and any injury or damage to entrant's or any other person's computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes. RWM reserves the right to cancel, terminate, alter sweepstakes duration, modify or suspend the Sweepstakes without notice. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE RWM'S WEB SITE OR PROMOTIONAL PARTNER OPERATED WEB SITES OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RWM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING SEEKING INJUCTIVE RELIEF. THE MASSACHUSETTS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE AND EXCLUSIVE JURISDICTION OF ANY CLAIM OR CONTROVERSY ARISING OUT OF OR RELATED TO THE SWEEPSTAKES, AND THE LAWS OF THE STATE OF MASSACHUSETTS SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. Entrants hereby release, discharge, indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages or liabilities arising from, related to or due to any injuries , damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, forbearance, misuse or use of any prize, or arising from or related to entrants participation in this Sweepstakes or in any Sweepstakes-related activity.

The use of any non-RWM trademarks, service marks, names, likeness and/or voice (collectively, "Property") in connection with this Sweepstakes, or the award of any prize, is not meant to imply the endorsement by RWM of the respective owner(s) of such Property, or any affiliation with or of the respective owner(s) of such Property, with RWM or this Sweepstakes.

RWM collects personal information from submitted Sweepstakes entries, which may be used in a variety of ways, including customizing features and advertising that appear on the Site.  RWM reserves the right to market promotional offers for RWM's network of sites or via third party partners.  Entrants may opt out of receiving future mailings or other information from RWM by sending an e-mail to optout@RacingJunk.com indicating their preferences.  

The name of the winner will be posted at http://www.racingjunk.com  through December 31, 2009. Alternatively, you may send a self addressed and stamped envelope by December 31, 2009 to the Company Address.
